Terms and Conditions of Use (TCU)

1. Company Information

The service is operated by QRIDEN SAS, a simplified joint-stock company registered with the Bobigny Trade and Companies Register under number 850 788 480, with its registered office located at 5 chemin de la Dîme, 95700 Roissy-en-France, France, operating under the commercial brand VyCab (hereinafter “VyCab” or “we”).

2. Purpose of the Service

VyCab is a platform connecting Clients with authorized Drivers/Partners licensed to operate as VTC (private hire drivers).

VyCab acts solely as a technical intermediary and booking platform.

VyCab is not the employer of the Drivers and does not assume responsibility for the physical execution of the Rides.

3. Acceptance of the Terms

Access to and use of the platform implies full, unconditional and irrevocable acceptance of these Terms and Conditions.

Any non-compliant use may result in sanctions, suspension or termination.

4. Driver Account and Registration

The Driver/Partner undertakes to provide accurate, complete and up-to-date information, including legal status or company registration, valid VTC license, professional insurance, valid driving license, and bank details.

Login credentials are strictly personal and confidential.

VyCab reserves the right to suspend or terminate an account in the event of fraud, false information, inactivity exceeding 90 days, or breach of these Terms.

5. Contractual Relationship

The Driver operates as an independent contractor.

No relationship of employment, subordination or exclusivity is created.

The Driver remains solely responsible for all legal, social, tax and administrative obligations related to their activity.

6. Driver Obligations and Ride Execution Conditions

6.1 Punctuality and Delay Management

The Driver must strictly comply with the scheduled pickup time stated in the booking.

In case of foreseeable delay, the Driver must immediately inform the Client, VyCab via the application, and VyCab Support.

The Driver must obtain and retain written proof (in-app message, SMS, or message relayed to Support) confirming that the Client explicitly accepts the delay and that the exact duration of the delay in minutes is clearly specified.

Without written proof of the Client’s acceptance specifying the exact delay duration, any pickup with a delay exceeding 10 minutes will automatically be considered a Driver No-Show.

Any delay exceeding 10 minutes is deemed a Driver No-Show, even if the ride is completed.

In the event of a Client complaint, this will automatically result in a full refund to the Client and a penalty equal to 150 percent of the ride amount charged to the Driver.

Only explicit, written and prior acceptance by the Client, stating the exact delay duration, allows VyCab to dispute a complaint.

6.2 Flight Delays

The Driver agrees to wait for flight delays of up to 3 hours.

Beyond 3 hours, the Driver may refuse the ride, which will then be refunded to the Client, without compensation.

6.3 Vehicle Safety and Compliance

The Driver undertakes to ensure passenger safety, use a compliant, clean, insured and well-maintained vehicle, and carry mandatory equipment including warning triangle, safety vest and child seats when required.

6.4 Professional Conduct

The Driver must maintain a professional, respectful and discreet attitude.

Any inappropriate behavior may result in immediate sanctions.

6.5 Confidentiality and Non-Solicitation

Client data is strictly confidential.

Any direct solicitation of VyCab Clients is strictly prohibited during the collaboration and for 12 months after its termination.

7. Payments, Cancellations and Penalties

VyCab collects ride payments on behalf of the Partners.

Earnings are paid to the Driver after deduction of commissions and any applicable penalties.

VyCab reserves the right to withhold or suspend payments in the event of fraud, non-compliance or dispute.

Client cancellations: pre-booked rides must be cancelled at least 3 hours before pickup; instant bookings at least 15 minutes before pickup.

Driver No-Show or delay exceeding 10 minutes with Client complaint results in a penalty of 150 percent of the ride amount.

8. Personal Data (GDPR)

Data Controller: QRIDEN SAS – VyCab.

Purposes include account management, bookings, payments and security.

Rights include access, rectification, erasure and portability.

9. Intellectual Property

All VyCab content, applications, software, trademarks and materials are protected by intellectual property laws.

Any unauthorized reproduction or use is strictly prohibited.

10. Liability

VyCab shall not be held liable for the execution of rides, the conduct of Drivers or Clients, or technical issues beyond its control, except in the case of proven gross negligence.

11. Termination

The Driver may terminate the collaboration at any time.

VyCab reserves the right to immediately terminate the account in the event of fraud, serious misconduct, repeated breaches of the Terms, or damage to its reputation.

12. Governing Law and Jurisdiction

These Terms are governed by French law.

Any dispute falls under the exclusive jurisdiction of the Courts of the Paris Court of Appeal.
